REFUND & CANCELLATION POLICY

This Policy applies to payments made for ACT Nexus Membership and, where expressly stated, other paid services, programmes, events, or activities offered by ACT Nexus.

This Policy should be read together with the ACT Nexus Membership Terms & Conditions and the ACT Nexus Terms of Use.

Unless otherwise expressly stated, the terms of this Policy apply to all Membership Fees paid to ACT Nexus.

ACT Nexus Membership is provided for a fixed period of twelve (12) months.

The applicable Membership Fee shall be communicated to the Applicant before payment is made.

Payment of the applicable Membership Fee does not by itself guarantee acceptance into ACT Nexus Membership where an Application remains subject to review and approval.

Once Membership has been accepted and activated, the applicable Membership Fee is non-refundable.

A Member may choose to cancel their Membership at any time by notifying ACT Nexus at info@actnexus.africa.

Cancellation shall not entitle the Member to a refund of any Membership Fee already paid.

Cancellation shall not affect any rights or obligations that accrued before the effective date of cancellation.

Following cancellation, the Member may continue to have access to Membership benefits until the end of the applicable Membership Period, unless the Membership is separately suspended or terminated by ACT Nexus in accordance with the Membership Terms & Conditions.

Membership shall expire automatically at the end of the applicable twelve (12)-month Membership Period unless renewed.

A Member may choose not to renew their Membership by allowing the Membership to expire or by notifying ACT Nexus before the expiry date.

Non-renewal does not entitle the Member to a refund of any Membership Fee paid for the Membership Period.

Any unused portion of a Membership Period shall not be refundable solely because the Member chooses not to renew.

ACT Nexus may suspend or terminate a Membership in accordance with the ACT Nexus Membership Terms & Conditions.

Suspension or termination of Membership due to a Member's breach of the Membership Terms & Conditions, Terms of Use, applicable community standards, or other applicable requirements shall not entitle the Member to a refund of the Membership Fee.

Where ACT Nexus terminates a Membership for reasons unrelated to any breach or misconduct by the Member, ACT Nexus may, at its discretion, consider whether any refund is appropriate.

Payments for ACT Nexus events, convenings, programmes, workshops, or other paid activities may be subject to separate cancellation and refund terms communicated at the time of registration.

Where separate cancellation or refund terms apply to a particular event or activity, those terms shall govern the relevant payment.

Where no separate cancellation or refund terms have been provided, payments for such activities shall be non-refundable once the registration has been confirmed, except where a refund is required by law.

Nothing in this Policy shall affect any refund or cancellation rights that cannot legally be excluded.

Where a refund is required by law, ACT Nexus shall provide the applicable refund in accordance with the relevant legal requirement.

Where a refund is required by law or expressly approved by ACT Nexus, the refund shall generally be made using the original payment method, where reasonably practicable.

ACT Nexus shall not be responsible for delays caused by payment processors, banks, financial institutions, or other third parties involved in processing a refund.

Any bank, payment processing, currency conversion, or other charges that are not recoverable by ACT Nexus may be deducted from a refund where legally permitted.

ACT Nexus may update this Policy from time to time to reflect changes to its services, business practices, payment arrangements, or legal requirements.

The updated Policy shall apply from the effective date stated in the updated version.

The version of this Policy applicable to a payment shall be the version in effect at the time the relevant payment was made, unless otherwise required by law.

This Policy shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any dispute arising out of or in connection with this Policy shall be subject to the jurisdiction of the courts of the Republic of Kenya.
